Desperate Men

DesperateDear Editor. After reading Attorney General Hon Justin Simon’s recent statement to the nation, and following on the PM, Hon Baldwin Spencer’s speech sometime earlier that whatever the Judges’ decision, nothing will change, and Chaku’s comment on Serpent’s UPP-SHOW last Thursday, October 22, it shows that desperate men will do desperate things.

It is obvious to me, as it was prior to the last election, that UPP operatives are prepared to do anything to remain in power - true Machiavellian-style power by any means necessary, and the end justifies the means. I am calling on the AG to think again.

Sect 69, 2(b) of the constitution does give the GG the power to appoint the individual in the House who in her judgement is “most likely” to command the support of the majority of members in the House. What does “most likely” mean, Mr AG, considering a 7-6-1 situation? In the realm of probability, the individual from the party with seven seats is most likely to command the support of the majority.

If, on the other hand, the constitution stated at the "sole discretion” of the GG, as you would have us believe, then yes whatever she does would be in order. Mr AG, you can interpret the constitution for your convenience, but you can’t change the words.


But then AG, Chaku did say on Serpent’s UPP SHOW that there are 19 members in the House, inclusive of the Speaker and the AG himself.

It is not surprising then that the UPP would be favoured by you to continue the governance of this State; it also explains the Prime Minister’s “no change” talk, since he is being advised by you and CHAKU. As Scorpion said, “Look what we come to."

Mr AG, one should be guided always by one's good conscience.

Please, the only desparate people in Antigua/Barbuda are those who do not know that Lester Bird will never be the Prime Minister of the state of Antigua and Barbuda again. Lester Bird will be a crazy bold face person who keep on telling the intellectual failures and dunces that he is the Prime Minister. Since 12th March 2009, the Prime Minister remains the Honourable Winston Baldwin Spencer... still is and can only change with an election. The case is over and so is the expectation of Lester Bryant Bird to be a Prime Minister of Antigua and Barbuda again....the Judges made the correct decision.

Despite our prejudices and bias, the law is the law and we must allow the law to take its course. The Representation of the Peoples Act is quite clear. We all know who the GG will elect as PM if given the responcsibility to do so. Hence the statu quo will remain. The UPP will remain in power. Thus all you ALP voters and Lester Bird supporters. The rule of law must prevail, whether we like it or not. We should be looking at the bigger picture and think and act for the advancement of Antigua and Barbuda. No disrepect to Jamaica, but unless we acct the rule of law and the systems that in place we will end up like that country at election times(shootings and killings). There could be no misinterpretati on of the Act. Lester would do almost anything to get back into power, even misleading Antiguans by releasing misinformation. Antiguans stand strong and do not be fooled by those who would have you believe their twisted version of events, just so that they could keep power or be voted into power.

I don't understand earlier comments saying that this article doesn't make sense. Bias perhaps?
The Governor General (and I use the term loosely) has been silent for two weeks on the results of a government initiated election tribunal costing the taxpayers hundreds of thousands of dollars. Why is she not forthright?
The Attorney General has made a public statement that mirrors earlier dictates from the Prime Minister informing Antiguans and Barbudans they can expect buisiness as usual even though no one knows the results of the Appeals Court ruling regarding our messed-up recent elections and disputed seats.
This whole thing stinks of partisan patronage, collusion, hypocracy, corruption, deception and downright desperation.

Cool Ruler, with all due respect, I am just looking at the situation and that is what I foresee. Whether it happens or not we will have to wait and see. I raised seven paints of argument and you find exception with one. However, it is not my place to defend them. These points were all taken from articles and discussions here on Caribarena. I do not see what is to be gained from turning back the clock. The actions of the past GG have nothing to do with the current GG and the potential problem that may arise.

Fnpsr Please don’t go down that road, name an instance when the current GG showed any preference to one party over another. I await your response. In the event your are able to find one I will relay to you instances of the former Governor General doing what you are accusing the current GG of doing.

It is my belief that tomorrow, October 27, 2010, may not be the end of the story. The reason I say this, is that both parties have different views and interpretation of the constitution and what has to happen if the Court of Appeal upholds the Blenman decision. Therefore, I can foresee another court action immediately. Here is why: (1) the PM says noting will change and the UPP will continue to govern. (2) MP Bird says he is wrong and that he is misleading the people. (3) While the certificate may be presented to Parliament, it may not be acted upon immediately. (4) There is the question of which party will command the majority. (5) There is the constitutional question raised by MP Bird regarding the BPM’s seat. Is he allowed to vote with a party? (6) There is the question of whether Gaston’s suspension will be lifted in time for him to vote, thereby affecting the count for ALP. And (7), while the constitution gives the GG the authority to appoint the PM should there be a deadlock in parliament, did she violate her authority by demonstrating past preferences for one party over the other, thereby, voiding any appointment, if made?

I too agree, we (humanbeings) want to win so much that we forget about the most important thing, the people, the country, harmony, togetherness, God, fairness. I pray both parties would go back and make all these number one again.

If UPP would have called a election right after the judge ruling, I promise you, UPP would have been one of the most respected Government Party in the world to freely relinquish power oh wow, I am in awe right now thinking about it, Maybe I would have turned UPP. I am speaking on fairness here not supporting ALP nor supporting UPP but i just crave an extraordinary Party and an extraordinary person, where are they?

PL is redder than the devil. Who is really desperate here? It seems to me that Bird and ALP are SOOO desperate that they want to be in power even for a little bit before elections. The government that was elected to rule in 2004 will remain in power until the next election (bye or general). Get that into your doltish head.

Your view are not my view, discretion means using of your logical self, using your intelligence and the other analytical sense to come to a conclusion which is fair, just, Godly, and the majority of people you represent would find as such.

Readers, my love for the law and the rights of people have nothing to do with the love of ALP, I just interpret the law and if the scenario the writer posted happen as a fair man, using my discretion, ALP would command support of the majority.

This statement is not saying i support ALP but I support the LAW (what it says) bring me better politicians and I would vote just like you for the better ones.

The point I am making to this writer is they have read the constitution perfectly, not saying this because it is in support of the ALP, even thou i believe they are a better Government incomparison to the UPP.

I am applauding the point i made yesterday and got curse out for it; you are mosre likely to command support from your sworn supports than a supporter who only simply sit next to you.

I thank this person for writing this, genius, I love the law and apply it neutrally, justly and Godly.

The ALP tried every trick in the book to prevent the Appeals Court from hearing this case. They stage demonstration after demonstration to disrupt the economy. And yet this jackass has come to the conclusion that the UPP are desperately trying to cling on to the seats that they won in the election. Wow!

I guess the writer of this story is not good at math as he/she states that the situation would be 6+1 yes that does equal 7 just so you know. And that does count as 7 as just recently in England we saw what can happen and how parties can join forces.

But I digress as we will all be attending Lester's retirement party as he said when he looses this case he would retire.

It is hard to make sense of this letter. Maybe that's because it doesn't make any sense?

The GG's the power to appoint the individual in the House who in her judgment is “most likely” to command the support of the majority of members is perfectly compatible with this judgment being solely her discretion.

This letter wasn't worth publishing.

Hey PL, the GG is not restricted to “the realm of probability”. Believe it or not all elected members will be able to sign letters attesting to their support for one MP or the other. All the UPP MP’s can read and write and while I can’t speak with confidence about the ALP front bench, they should all be able to mark “X” at least. Yes, really, it’s as simple as that.
