PM and Samuel to AppealAntigua St John's - Prime Minister Baldwin Spencer and Electoral Commission head Juno Samuel will appeal the High Court judge’s ruling in the lawsuit recently won by former chairman of the Commission Sir Gerald Watt QC.

Attorney General Justin Simon will, however, not be joining them.

Senior members of the United Progressive Party (UPP) have recommended not to appeal the decision.

“My own view is I am not sure that there will be any significant merit in pursuing an appeal, but at the end of the day, we will take whatever actions are necessary on advisement,” Minister Harold Lovell was quoted  in The Daily OBSERVER as saying. “Mr Watt has won victory and it’s a first-instance judgment. We’ve had a first-instance judgment in the past, in the election cases. We had a first instance-judgment then our view prevailed at the level of the Court of Appeal."

Extensive efforts to reach Lovell on Monday for further comment on the matter proved futile.

Watt has meanwhile said the prime minister’s move is yet another reflection of the attention paid to “a clique of noise rather than the more thoughtful people in his party."


The appeal was filed on Friday on the grounds that Justice Jennifer Remy got every point of interpretation of the Representation of the People’s Act wrong.

Sir Gerald Watt's lawyer, Dr David Dorsett, will continue to represent him. They will look to not only win the extended challenge, but do so in more areas than in January, through a counter appeal.

“It is a very strange point of appeal,” Dr Dorsett said, adding that it was interesting that the two would pursue an appeal without the AG.

He added, “The grounds that were advanced are going to meet with some struggle… They are saying that nothing that the judge said as to how that section of the law was to be interpreted she got right.”

Sir Geraldo said neither the rime minister nor Samuel have to worry about the cost of the proceedings, since they will not be paying out of their pockets for what is clearly as “let's try a thing” kind of challenge.

I do believe the Judge Remy's interpretation of the law is on point since the PM didn't have any "legitamate" reasons to remove Sir Watt! Remy also stated that

Lorna Simon had taken "full responsibility" for the 2009 election debacle but yet the PM still went ahead for a Tribunal that was unsuccessful in removing Sir Watt and Paddy. On this appeal, the PM and Samuel will have us "foot the bill" when the strong tides are against them! With no AG on board, guess he wanted no part of this duo fallen-deck?

What a disgrace that upon the news of PM BS appealling, the only thing I'm hearing on ZDK is happy birthday wishes to the FORMER PM. In all my years on this earth, the ALP has to be by far the weakest opposition party I've ever seen!!! What a bunch of BAFFOONS!

ALP should be hammering these UPP fools over their continued misuse of the people's money. But instead they're wasting precious air time on birthday greetings!!!!!! !!

I feel sorry and ashamed for the people of A&B.

There is no surprise here. When you are spending other people’s money, you do so with reckless abandon. When you are spending your own money, you do so as a prudent person would. You spend it carefully and thoughtfully.

If they loose the appeal and they probably will, they should be made to reimburse the treasury.

would you really appeal such case, even the dumbest man on earth knows this is correct. What will he do next, fire judges when ever he feels like it because he does not feel like he wants them to be a judge?

This is a no brainer. It was obvious they would do this. Not only does it buy time for the PM and Juno to do more rigging but it also gives them an opportunity for their lawyer friends to make some more money off the back of tax payers. They know they will not win ... it's all about the time and money.

hmmm, I clearly remember seeing one government minister celebrating victory the weekend BEFORE the judgment was handed down by the Court of Appeal. That's 4 days before judgment was read.How could he have known, who could have told him, an insider perhaps?
Or was it just "intuition"?

Who is going to pay for the appeals? Surely not the people of Antigua and Barbuda. This government need to stop wasting money. We have bigger issues that need attention. To high paying many Boards, the need for more police personnel and better health care system. Whatever happened to the reshuffle of the cabinet?

This is just ridiculous. What turns on this? In anticipation of the expected loss in the court, Dr BS has already changed the laws governing our elections. The laws, under which the 2009 elections were held, have been repealed. The Electoral Commission has been re-constituted with UPP hacks. Why waste our meagre resources to chase this shadow? Sir Gerald has found favour with the courts twice. Even with his victory, Sir Gerald is no longer a member of ABEC. Why is Dr BS wasting our hard-earned tax dollars to prove that he is right, even though it is as clear as crystal that he is dead wrong?

Too many try-a-ting moves indeed. There is a noticeable trait in Antiguan men. We don’t like to loose even if we are wrong. We can’t say sorry, we don’t know how and we walk around with our wods in our hand just to prove who is bigger. Looks like more tax payers money down the drain. a good student in mathematics can calculate the probability of failure: P(E) = Number of outcomes in event E = n(E)
Total number of possible outcomes n(S)
n(S) = the amount of time they could possibly win. E = the event(appeal in court and win) Since you can only have that one appeal, then n(S) = 0. P(E) = n(E) = 1
n(S) 100
The probability in comparison to the problems that can occur is too low.

So am I to understand then that the Judge don't know the law and The PM and Juno know it better than her cause she did not interpret the law in their favour!

Spencer the majority of us will show you what we interpret your poor decisions to mean....do us a favour an leave office now! I have had enough of you spending quality time and money in Court and not enough time focusing on bringing this economy around and focusing on the people!
