A Case For Commission Of InquiryAntigua St John's - The Antigua Labour Party has made a case for the establishment of a Commission of Inquiry to probe into all the issues surrounding the Wadadli Power Plant that was commissioned last September, and which has been experiencing a series of challenges since that date.

Representative for St Mary’s North Molwyn Joseph and Senator Lennox Weston used the Fire and Steel radio programme to lay out in detail a case for an inquiry into the WPP affair that has captured the attention of the nation for more than six months.

Noting that an Inquiry is the official position of the ALP, Joseph read from a legal opinion on the matter, which stated that Commissions of Inquiry are a feature of modern democratic societies, and that such probes help to inquire into things of great national concern.



According to the legal brief…inquiries are not judicial proceedings but are fact-finding by nature. It said Commissioners are normally appointed in times of great public disquiet about some aspect of government or some problem of widespread public concern.

It said one of the key differences between an inquiry and an investigation is that an inquiry has wider powers as it takes evidence under oath and that it has subpoena powers.

In amplifying his point, Joseph made reference to the report by Justice Don Mitchell who led a government investigation into the proposed acquisition of power generating equipment from Canada by APUA.

In the report, Justice Mitchell advised the government to seek senior legal advice particularly from an attorney with experience in this area, before entering into any contract with any entity about power generation or other major equipment. Joseph said the government ignored this advice from Justice Mitchell when it entered into an agreement to purchase the equipment from China.

Joseph added that there’s no evidence that the government sought advice from people with the relevant experience and skills before entering into the agreement to purchase the plant from China.

Justice Mitchell said this was needed to protect APUA’s interest. According to Joseph, what happened in the case of the Mitchell Report is proof that Prime Minister Baldwin Spencer cannot be trusted to implement recommendations from an investigation even in a case where he accepted the said report.

Joseph noted that the agreement also contravened a number of the country’s laws.

These include the fact that the agreement has not been brought to parliament as required by the Finance Administration Act of 2006; that it was never submitted to the Tenders Board for vetting as required by the Tenders Board Act, nor was there a waiver of tender that is also required if a matter is not placed before the board.

This is coupled with Spencer’s refusal to make critical documents related to the project available to members of parliament and the media.

Joseph also made mention of Ambassador David Shoul’s refusal to appear before the Public Accounts Committee even after he was summoned.

“Why do you think that he will appear before an inquiry when he refused to appear before the PAC?” he asked.

For his part, Weston said he dismisses out of hand any call for an investigation into ‘value for money’, a point that has been made by ALP Chairman Gaston Browne.

“We are calling for an inquiry, not to investigate value for money, because value for money is very apparent in the case of WPP,” he stated.
Weston said the call for a commission of inquiry is based on the following points;



a) there are concerns over the price paid for the engines as the manufacturer posted a price on the Internet that is significantly lower than that stated by government officials.

b) that despite the government’s claim to the contrary, the ALP’s claim is that the engines are used and if that is the case, then there is fraud, and

c) that if after nine months ‘new’ engines can’t get insurance then something is wrong.

Weston added that the CI must look into fraud, corruption, contravening the laws, and placing undue burden on the population from higher electricity costs.

Yet again, the current crop of 'leaders' of the only party that ever truly championed the cause of the authentic inheritors of this twin-island state has dropped the proverbial ball. This mess surrounding the allegedly fraud being perpetrated against the people of A&B will peter out to nothing thanks to the criminals parading as leaders - current/potenti al - deliberately continue to mislead the ignorant m** in their quest for power, sweet power. We are now faced with a dilemma - more B***S*** from the "Doctor X2" or the possibility of a lame duck/madman. Either way, our history, culture, traditions and aspirations are seriously endangered.

Yesterday I heard so far the best method to force the government to hold an enquiry in to the WPP. If all the person who feel very strong about this it would sent a strong signal. The person on the radio sad to cripple APUA by not paying our electricity from this month. Yes we will suffer being cut off but that sure is worth it. Cause I can tell you APUA will feel it even worst when monies are not coming in. But it will only have effect if a couple thousand people are participating in this. Antiguans need to start being creative cause Marches alone do not put presure on Baldwin. We need to systematically start targetting government where it hurts them. One or two sick days a week is another way. A go slow in certain departments of government offices. But we need a leader to mobilise us to do all these things little by little. Will the real leader stand up.

Jeb I too had simular sentiments of Why ALP do not follow suit with countries like Guyana and others. I did some research and found out that it is not as easy as we thought. China's govt only handles issues like these from a government to government basis. It was the former President of Guyana who brought the situation to the attention of the present President for him to act on the information. It was UPP when in opposition, who demanded a commission of inquiry for the medical benifit scheme, and their wish was granted. I am quite sure they acted on behalf of the people, who wanted justice for their hard earned money that was paid into the scheme. Under their governance, the guilty persons were prosecuted and had to pay back the MBS money with interest. Now that the UPP govt has now find themselves in the same position that the ALP had in the past, they refuse to adhere to the peoples wishes. Depending on ALP alone to do something is not the only solution, we need to stand up for our rights. We are the ones who feeel the pain in our pockets. Stop pay APUA, stage demonstrations, do something so govt will take us seriously. Something must be done sooner than later.

It was said by MP Bird on radio last week and it came over as if he was being dissuaded; it was mentioned last night by MP Joseph and Sen. Weston…taking the issue to The World Bank, and the anti-corruption department in China. I wonder every day WHY, since this proved a successful method for East Timor, Guyana and others, is the ALP party not following suit NOW? Has Antigua not reached such a widespread state of suffering that time is of the essence to bring this issue and the abuse to an end? IMO BS is so power obsessed and ingrained in the cxxxxxion that he will not respond to march or shut down pressure and that is just more time slipping by while the country burns into a cess-pit of bankruptcy from bad governance. BS, DS cannot avoid outside pressure. BS's cohorts are unlikely to jeopardize themselves and their power/high life by going against BS. It is not a show of weakness to request help from outside powers when a situation gets out of hand…to me it is a show of upstanding ethics. We know “investigation” will achieve nothing; I suspect it will be difficult without help to force an “enquiry”, so where does that leave the people and country... never-ending nowhere!

Whats the purpose of holding an inquiry other than to name and shame, please do not get me wrong when things go wrong there should be some sort of an investigation into the matter and the responsible parties feel the full weight of the law, but as far back as vc time there has been one inquiry after the next and nothing has changed the person/s end up with eggs on their face and thats it business as usual, if we want these inquiries to carry any weight it must carry the strength of the law and the recomendations must be binding other than that it's a fools exercise.

I am of the view that "democracy" shouldn't be "undermined" or fall to feet of destructive "leaders!" By the way, Godfather, it was that same democracy that was "crying blood" in 2004! They voted in great numbers to see "change" because of "promises" made to them! "How sad" that since 2004, they have seen the "wrongs" remain "right!" In order for our democracy to work, as, you have said before, we can't put "private interest" over "public interest!"

Godfather, just remember that the "world wasn't built in a day." Sure, we all would like those that "guilty" of "corruption" to be held "accountable" to the full extent of the law! This is why an inquiry or investigation is needed in WPP but I am not sleeping on it? I doubt the people will ever get their fair-share of "justice" when we have folks that are willing to stand in front of a canon to protect these "politiquitcian s" from any accountabilitya ny! Our "politricks" is at the highest level I ever seen in this country, and, it is "dividing" the country, and, hindering "ecocomic-and-s ocial" progress of those affected extremely! And, the loyal "institutions" that supposed to be watching out for the people interest are yet to prove they are more than "hot-air" and a "wondering-hord es" of sheep and goats! It all starts with us to do right and not take "trinkets" to "distract" us to stop the nation's bleeding!

By the way there is a saying in legal circles “He who accuses must prove” so if they are accusing The Government of China, The Government of Antigua, the Board and Management of APUA, The engineers of APUA, Shanxi Diesel Engine Heavy Industry Co Ltd (SXD) Xi’an Marine Equipment Engineering Research Academy (XMEA), Beijing Construction Engineering Group (BCEG) and MAN Diesel and Turbo SE Germany of deceiving the People of Antigua and gibing them a six for a nine let them prove it. After all with all the leaks of government documents and confidential information, how come one of their sycophant supporters hasn’t passed the smoking gun to them as yet if it exist?

If you feel so strongly about it by saying “Its time to send a message to the PM that if an inquiry is not called within a week, a major March will occur along with s promised shut down of the country” why don’t you lead the charge? Who you waiting for Choko Weston or Molwin who is just full of wind to start it? I can think of a few items that need to be inquired into before we get to the power plant, like IHI, the free trade zone that was headed by the man you going to vote for not to mention the APUA funding, after those then we can get to the power plant.

Any corruption that took place leads to Nxxxxe Street.
This is who the Lone Wolf should be tragetting. Not the Chinese.

The Power Plant issue is different to the Fences scandal! The power plant affects everybody! In addition, we could demand a full independent inquiry with everyone fully investigated.

I think that this is a way to get the benefits of an inquiry without having to wait for the GG to agree! If all the NGOs get on Board and demand a full investigation, then things could start to happen.

Pushing for an inquiry will only occur IF enough of the people rise up and cause unrest. That I doubt will happen! So let's hold Dr Dr feet to the proverbial fire and get this thing started!

Please put aside egos and demand more! A precident has been set! Baldwin fired Wilmouth from APUA after the Don Mitchell report!

Molwyn Joseph & Lennox Weston have made the case for a commission of inquiry and their facts gives support for their reason. Who can remember the 65 million dollar fencing scandal? A COI was asked of the GG and she refused citing theirs no need. The govt conducted an investigation and the result stated that IT SHOULD BE CONSIDERED A LESSON LEARNT. Is it fair for tax payers to make major life adjustments to pay govt taxes for them to squander our money and award it to their chosen few under the guise of development? A commission of inquiry would be the best solution for this scandal. Govt investigation is like HAVING A RAT GUARD YOUR CHEESE. We are being govern by a currupt bunch G and all. Our country needs to launch a form of civil disobedience for govt to take us seriously. We need to STOP PAYING ELECTRICITY. Maybe the country needs to be in darkness for UPP to grant us our request. This is not an ALP thing. We the citizens are the ones who suffers through all of this. Just imagine; a new power plant accompanied with higher electricity bills due to higher fuel variation charges and people still wants to defend the UPP with their nonsense.JUST GIVE ME A BREAK!!!!!!

There was more money misappropriated to private accounts than the WPP cost us. At lease this power plant will supply us power into the next generation. Money in private accounts has gone forever.

With an inquiry all the revelant documents will and must come out to the public and there i**hink it would be better than an investigation. They will have to bring all relevant documents to the table and not what they feel, we need a patition or something, to long now these people blaming everyone else for their poor poor managing of the country. Straight up these decisions are paying its toll on the pockets of Antiguans and Barbudans. Persons must be held accountable for their actions. My reason for blogging is to shine light on peoples political bias, an it is evident in this instance. The self-righteous are always ready to march against all manner of evil other than their own. Not that they are wrong, in a democracy their rights are protected.

But, where were they when democracy was crying blood, many are surely in need of a re-education and a new perspective. There are many who deflect corruption pending issues involving the past regime, blinded by political loyalty, they concentrate only on the present! How sad?

I said it a long time ago. It is time for us to walk, talk and act like the Egyptians. Had we done that, the UPP would have been historyl. We don't want an investigation. Baldwin would offer such because he knows he can maniuplate it. We cant a commission of inquiry where those who have allegedly wronged this country can defend themselves or face the consequences of shame. No one can trust Dr. Dr. to have an indepentent investigation. the guy is much to sxxxish for that. Antiguans, it is time for us to rise up and take back our country. Democracy is definitely under seige.

@Slapping Hand you are so right. They just played in the PM hands. All the PM has to do now is to turn the matter over the GG and ask the labour party to act accordingly. Ironically, the request for a public enquiry was turned down a couple months ago and there was no insistence by Molwyn and the others for one. Gaston came with a master stroke, have the PM considering an Independent Investigation and even before the PM responds, the labour party is giving him the perfect excuse. An independent investigation should be successful in proving the engines are old and set the stage for a Commission of Enquiry. There goes another egotistical blunder by them again.

A major march would send a message to the powers that be that we are serious and that we want answers. However, I do not think that shutting down the island would serve any useful purpose, especially in these hard economic times. You don’t want to cut off your nose to spite your face. Keep in mind that you are weeks away from the biggest festival, Carnival, and you don’t want countries advising their citizens to stay away from Antigua. This would have a devastating effect on an already crippled economy. I can understand the emotion, but let’s think it through!!

So Baldwin agrees to have an investigation.. .the ALP refuses...Baldw in then says well only the GG can call a Commission of Inquiry...the GG refuses again saying she sees no evidence of wrong doing!!!

Baldwin sings and dances that he has offered the investigation - it's not his fault that the ALP refuses!

Then Maulwyn can't allow Gaston to benefit from getting the PM to call the Investigation and show him up! No matter how independent it is made!

Why are these Politicians so hell bent to play games with important issues like this?

It can't be missed, it's quite obvious, that the ALP is after the same thing, that is the removal of the ruling UPP Gov't from power. The issue is not is if and when it occurs, WHICH FACTION WITHIN THE ALP WILL HOLD THE WHIP, GAVEL, THE CUTLAS HANDLE, THE SIGNATURE PAD FOR THE TREASURY, etc. Will it be Gaston's Gang or Molwyn Gang? On the other hand, China will still get her money, the liaz/lawyers get paid thousand of taxpayers $$$$$$, leaders of UPP & ALP fly to Taiwan together to be wined & dined to the entertainment of Asian strippers, AND DOURTISH NEARGA A GET ROB AND A HOLD DEN BELLY A CRY, ARWE HUNGRY, A WEH ME PAYCHECK DEY....dem belly full but we hungry and a hungry man's an angry man, but Jah no dead....

Rermember when MP WD called for a Commission of Inquiry,his letter was taken to Cabinet,the cabinet and the UPP big WIGS,thinking there was no NEED for a COMMISSION OF INQUIRY.
A COMMISSION OF INQUIRY IS WHAT IS NEEDED THE CHINESE / WPP AND THE FENCING SCANDAL.
