IHI Special Constable Appointed

Supt Nuffield BurnetteAntigua St John's - Head of the Criminal Investigation Department (CID) Supt Nuffield Burnette has confirmed that Sanjeev Datadin has been sworn in as a special constable to work with the team of investigators probing the IHI matter.

Datadin, a Guyanese attorney, was the lead counsel in the tribunal set up to investigate three members of the Electoral Commission in September 2010.

Burnette described Datadin's role in the IHI matter in broad terms, ie that he would assist the team with its investigation.

The senior police officer added that the investigation was not adversely affected by the theft of files from a cabinet in the High Court building.

“We are close to finalizing the investigation, and as you are aware, closing an investigation normally means arrests and the filing of charges,” Burnette said.

As for the police identifying Sir Ronald Sanders as "a person of interest," Burnette said the police were justified in circulating a bulletin not only locally, but regionally and internationally.

“His name came up as one of the players in this matter, and he should at least be subjected to an interview that would either implicate him or clear his name,” the officer noted.

He would not comment on whether there is evidence of wrongdoing on Sir Ronald’s part, and would only say that the former diplomat needs to make himself available to the local police.


Additionally, he noted that the police are standing on good legal ground in this regard. “The first rule of the courts is that whenever the police are conducting an investigation, they have the right to interview anybody from whom information may be collected," Burnette said. "Even in cases where the person may not necessarily be a suspect."

The superintendent said the police may also seek assistance from Interpol to secure an interview with Sir Ronald. He said an official request is being considered, but acknowledged that the international agency would only assist if the information provided by the police is significant. “We know what information we have,” he added.

SO according to the AG, this never took place as the act itself was illegal? Brown they hanging you out to dry, the AG and Cort said they knew nothing of this and it cannot be done.

Tenman, all along I thought that this case was a civil matter. Based on response to Skyewill, if the police are investigating the case to determine if it is a criminal case, then it is a criminal investigation. And as I have said before, Sanders is not obligated to talk to them. If he talks to them and they decide to bring charges against him, then they can use his statements against him. It would be foolish for him to talk to them, knowing that they are conducting a criminal investigation, and thereby incriminate himself.

naiomi , yes its all a mess and the government has been busy trying to hide the real problems. The issue with the uncovered holes on those side walks is one that this country has had to pay out significant sums of moneys due to law suits from tourists. Whats even more sad is in action some of the sames holes we are paying for via settled law suits are still left uncovered.

what is so sad about the files being stolen from the courts is that not one person lost their jobs over it. It is business as usual. This is very troubling and I find this government along with the police is deceiving the citizens of Antigua and Barbuda and we are doing nothing about it. They are very deceitful with Sir Saunders issue also

Cool Ruler I am trying to get you to see what skywill himself has already seen. The entire case has been tarnished due to political involvement. You have just before the 2009 election, the UPP holding a rally at justice square and setting up a Kongaroo court where ALP members are put on trail. You have the PM making statements via the airwaves during a national address that ALP persons are guilty of having offshorebank accounts etc.. The PM then has to appologize to MP Browne and Lester Bird not has him in court for defamation. Take the time to read the report of the defamation case and note the AG stated what the PM said was not legally correct. As you stated Panday claimed political victimation and I think I showed you that he proved it. Isn't this the same thing said of George Walter's appeal victory ie that it proves he was being victimised? The police instead of ensuring that their case appears neautral now signs on the UPP lawyer as a special counsel. The UPP by their actions have allowed politivs to be at the center of this matter and will see this all come to naught

I just returned from Antigua and our country is in a mess and they are finding time for this nonsense. There is not one road in Antigua that is not in urgent repair. My God it is a total disgrace. The playgrounds that they spend so much money on fencing is full of g**. The beaches needs cleaning from bushes and weeds. Customer service is lacking just ask the workers at the airport. The only thing I can say is that St. John's is clean but the sidewalk needs to be fixed. A tourist got injured by one of the open holes she dropped in it. I was couple steps behind of them. I had to help assist her, This is the industry that we are relying on and there are no roads for them to drive or walk properly. Imagine falling in a hole in the side walk in the city.

John French II I did respond via the first story providing his website contact us page url. Took me no more than 5 seconds to think of it and find it. Atleast one person used that address and had no problem getting him. I simply concluded that the intention was not to contact him but to try to embra** the man. I have no doubt that Ron Sanders has been in and out of Antigua within the past three years. Pretending such a public figure is a diffcult man to find is simply rediculous. The minister in charge of the police is also the chairman of the Caribbean Community Counsil of ministers of National security and law enforcement (CONSLE). He provides directions to CARICOM Implementation Agency for Crime and Security (IMPACS). They made no efforts to pretect the alledged precious documents stoten from the court house, they also made no real attempt to contact Ron Sanders.

Ok let me clarify. The reference to pandae was in regard to how long the investigation took before charges was eventualy brought against him. Nothing to do with the verdic being overturned. You are looking at that perhaps to make the point that the samething could happen in this case but i dont think coming to that conclusion may be somewhat premature as no charges have been laid as yet.

Notes From A native Son Of The Rock. We have a Good Hon Dr. Minister, unelected senator, with the ear to cabinet, who touts the nation's IT advances given the penetration and high use of cell phones. All around him applaud and shower praises lacking in Ethos & Logos but full of Pathos. He threatens Service Providers should they not move to 4G. To what end? Many jump on the Bandwaggon with nary a thought of what is the purpose.
Will this be used to advance the creative abilities of Antiguans & Barbudans?
We have a culture of consumerism. Is the Educational Strategic Plan geared towards developing creative and entrepreneurial minds? Where is the direction towards Research in the colleges and institutes?
Any student with a blackberry, iphone or computer would have easily found Sir Ron with the aid of google. You would have been directed immediately to his website with a Contact Link in Full View.
Persuade me that there is a Culture of Research in A&B. If we do then the RABPF is woefully inadequate in its use of IT which both the Good Drs. Hon Ministers Responsible should be held accountable.

And tenman as Winston Derrick would say, "what turns on that" if or when charges are filed and they happen to be found guilty they certainly have the right of appeal which they will no doubt utilize using their vast resources. The verdict may or may not be upheld but as of right now it looks like they may have a case to answer.

While the police may have the right to interview any one, they do not have the right to compel them to speak. Furthermore, since this matter may lead to criminal charges, I don’t think his lawyer will advise him to talk to the police.

Burnette should cut the bull and if he has a case, as he appears to allude, then he should charge Sanders and issue a warrant for his arrest. or shut up.

This appears to be nothing more than “gamesmanship”.

Interpol, you can’t be serious? Isn’t this a civil matter?

It appears that Burnette is over his head and I would have hoped he would have cleared his comments with the lawyer COP. Oops!

Closing an investigation does not mean arrests and filing of charges. It means that the investigation has been concluded. Now, based on the findings of the investigation and the recommendations by the investigative body, charges may or may not be filed. Now, is Burnette showing his hand?

If the investigation was not adversely affected by the theft of the files, then why the need to rebuild the files?

Burnette said that Sanders name came up during the investigation and therefore they needed to interview him and, as such, was justified in putting out an APB on him. This is ridiculous, because as I understand it, this case is a civil case. Furthermore, CA was able to contact Sanders and evoke a response from him.

Datadin is now "Special Constable?" Never heard a lawyer getting such a "prestige" title! Why not give him the Commissioner's job as well? Datadin was not effective in the tribunal so I don't know how he is going to be in IHI investigation? Burnette it is about time you stop talking like a politician, and like a COP! You said "we know what information we have." Yet, you already "implicate" Sir Ronald in the court of public opinion! If you are considering "Interpol," to get an interview from Sir Ronald, the matter is serious, a**ernational cops take them. If it turns out that Sir Ronald is an innocent man, the damage is already done, and, he has no choice but to sue the police and the government for "defamation" of character! Yet, fighting legal battles are the norm of the day for the powers-to-be than fighting the "real" plights of the people!

It is well known that professionally trained career police officers had pursued legal training to become lawyers. Before this Caribarena news story, it was not known that lawyers had reversed their "...LEGAL PRACTICE" to become "...SPECIAL CONSTABLES."

Such indicates that lawyers so appointed, or any person, irrespective of previous calling, are vested with "...POLICE POWERS OF ARREST AND DETENTION."

This may be seen from Section 74 that states "...Every Special constable shall, during the term of office, have all such POWERS, AUTHORITIES AND IMMUNITIES, and be subject to all such duties and responsibilitie s as are CONFERRED or IMPOSED upon a member of the POLICE FORCE."

Is Burnette suggesting that in general all investigigation s result in charges being laid? A google search using "closing an investigation and charges" reveals results showing the opposite. It would be interesting to find out if Burnette's assertion is true for Antigua how many of these cases actually result in a guilty verdict?

Lies,pure political lies and it is sad to see our police force is manipulated and have become a political football . Burnette do you know a office Smith from John Hughes he was not a football to be used on labour day and is is out of a job. Why have not the ranks and file of the police force stand up for your own . Since the police force is being used as a football the police football team has gotten so confused that they do not know if they are the football or footballers . They they have not won a single game in the ABFA while goals in galore are scored against them . Oh my--- Antigua.
