Three Years’ Probation for Lay PreacherAntigua St. John's - St Claire Archibald, who pleaded guilty to serious indecency, was placed on three years’ probation when he appeared in the High Court before Chief Justice Keith Thom.

The lay preacher, accused of committing the offensive act against a 14-year-old girl, was placed on remand days before the judge’s ruling.

Before the pronouncement, the mother of the complainant made a passionate plea to the court for mercy.

“Everyone has erred, and in my case I have erred a lot, and without the grace of God I don’t know what would have happened with me and my two daughters, who are without an earthly father,” she said. “I believe Mr Archibald has paid the price, and I know that any judgement which the court would set on him, cannot equate to what he has already been through. I am very close to one of his daughters, and she is suffering immensely, and I think depriving her of her father would not be true justice. I have forgiven him and so has my daughter.”

She added that at first, her daughter was shaken by the incident, but with the help of the church and close friends, she has overcome the ordeal, and is mainly concerned about the man’s daughter, who is her friend.

Attorney for the accused man, Steadroy “Cutie”  Benjamin, in offering mitigating factors, told the court that Archibald is a shadow of his former self, and said the experience has taken a toll on his physical appearance.

Benjamin also said that his client’s 11-year-old daughter, who previously lived with her father and brother in a one-bedroom apartment, now stays with her mother.

In addressing the court, Archibald, who was remanded last week to get a feel of prison life, spoke of his experience.



He said, “It is a very difficult place to be in, but it gives you an opportunity to reflect on the past and make conscious decisions. I had to sleep on the floor, with only a mat. The floor is very hard and cold. Food is limited, you don’t have a choice. You just have to take things as they come. You have to listen to all kinds of conversations, swearing, and have to work real hard to keep your mind.”

Justice Thom told him, “You were sent there for you to see where the path you embarked on can lead to.”

Archibald continued, “Home is a place of comfort, you have better living conditions, you are able to prepare your meals when you want, and prepare what you want. You have your friends and family. In prison you are alone.”

He told the court he would not like to be in any place like that again, and said, “I regret the whole matter and I do not intend for this to happen to me again.”

In light of the position of the victim and her mother, coupled with the strong support of the church, which was evident in court, and other mitigating factors, Archibald was placed on three years’ probation and ordered to get counselling, to be arranged by the probation board. The chief justice also requested a report every six months.

If Archibald breaches the conditions of his probation, he will be brought back to be sentenced for this crime, and will stand trial for the additional offence.

He should have his picture taken and put in a sex offender data base in Antigua, also he should register as an offender and have to give an update to the child abuse/ sex offender department if he moves from his current address. Time for a change and Antigua really needs it.

SHM..This makes me SICK and we wonder why issues such as Gender Violence is not taken seriously!!!?????
Because they are PEOPLE who deem it LEGAL to commit such crime as this one.
If it is LEGAL / OK to do this to a young LADY what message is it sending to our MALES???
If this happens to her from this young age what kind OF A WOMAN are me developing and what is going to happen to our culture?
IS this child going to grow up thinking it is okay for this MAN and other man to treat her this way??!!!

No one seems to be considering the poor girl/child here - she is being made to forgive and even to try to forget, while her abuser is getting all the sympathy and attention. Amazing.

Justice should be blind but in this case his/her eyes were wide open. As leaders whether socially, politically or in our courts we have to ensure that our actions send the right messages. The convict in this case fits some of the text book profiles of an abuser - he held a position of influence, trust, was closely associated with the victim and leveraged his position to perpetrate his abuse. We are sending the wrong message especially at this time when there is an exponential increase in this type of crime. I hope that we have not created a precedent that will be exploited by other sexual predators.

This mother has no shame, by her admission he was a father figure to her Children,which makes his actions even more disgusting.Did she know what was happening,its all about $$$$$. When God forgives, it does not mean you are free of the consequences of your wrong doing,they are all hypocrites.

Where is the justice in this case? It seems that St.Claire is the victim in this case, and the young ladies are villains. wow! What a sick, twisted, world we live in. Anyway, GOD, is the ultimate and final judge of all humankind.

The way I look at it is this way: The judge must decide(and without the influence of the victims and their families) the appropriate punishment for offenders convicted of committing a crime. Here,justice was not served because nobody (including the judge) is thinking about the victim,they are more concerned with how well life goes for Archibald - and that's sending the wrong message to society. If, as a religious leader, Mr. Archibald's value had been about how best to treat other being,he would not have violated the teenage girl.

I happen to know this "Lay Preacher" for several years. As a matter of fact, I know his entire family. So, I speak unbiasedly. My issue with this judgment is that it sends the wrong many. The problem of sexual assault of any kind is not being taken seriously throughout the Caribbean. Why do offerders get away so easily? These assualts are very common among us. Many victims do not speak out for this very reason. I also know Justice Thom and from what I know of him, he's a pretty decent man. However, I am disappointed with the way the justice system handles cases such as this one. I also hope that he considers himself fortunate for a second chance and that he will not victimize another human being. xnow needs to go to his xx xxand He and others needs to remember that children do not remain children. They grow up and remember the things done to them. That's my two cents.......

I can only assume that this is a country of dog-gone hypocrites and parasites who will tell us all about the Lord, the lessons of forgiveness and the hardships that can occur if the perpetrator is incarcerated. Unfortunately, this only applies in selected cases.

May God have mercy on ‘poor people pickney’.

Antigua is a very strange place. Our “justice” system is even stranger, if not completely warped.

None of us would be comfortable with our teenage daughters being in the company of an individual who limes on the corner, smoking weed, with his pants below his bottom. On the other hand, our hearts would be at ease when they are in the company of their school principal, especially when that principal is a Lay-Preacher.

Alas! What meets the eye is not always the absolute truth.

This predator took advantage of his position of trust, and violated a fourteen year old student, only to receive a slap on the wrist from the presiding Judge.

If the perpetrator was a youth from the Point or Grays Green community, a minimum of 6 years would have been meted out. But compassion flows, and forgiveness abounds for these vagabonds. POWA, WAR, Christian Council and Gender Affairs remain mum.

Today is International Women’s Day, and the Media reminds us of the many challenges faced by our Mothers and Sisters, Daughters and Nieces.

What a cover up!!! If he was Catholic, they would have stated the name of the church. Is only in Antigua they "protect" certain churches and bash others. :sigh: So he gets probation because he "regrets the whole matter and does not intend for it to happen again." wow! Can I commit a crime, say sorry and walk away scott free too???? Forgiveness does not mean that you do not suffer the consequences of your choices.
