Prison Officer Released from Jail

Prison Officer Released from JailAntigua St. John's - The prison officer, Donald Lumsden, who was convicted and slapped with a 6-month jail term by Chief Magistrate Joanne Walsh on January 8th, is said to have been mysteriously released from Her Majesty’s Prison last Friday.

Caribarena has learned that an attorney who was in the process of preparing documents for an appeal against the conviction and sentence was amazed to learn that his client was freed.

Information from reliable sources revealed that another attorney appeared to have clandestinely intervened in the matter and had secured bail from the High Court.

Court information suggests three main grounds of appeal:



1. The suspected drugs were not analyzed and declared by a qualified analyst to be a prohibited substance.

2. The trial magistrate erred in admitting the drugs into evidence without an analyst certificate as required by law.

3. The conviction was null and void and was of no legal effect.The conviction and sentence ought to be quashed.

Caribarena has also learned that the documents for the appeal have been served on the clerk to the Magistrates Court and the police.

Do anyone know if they caught the guy who escaped at the airport as yet? This is what I mean by prioritizing. If they want do something maaybe fine the person like a traffic ticket. The UK and Canada and the USA have already decrimilized it for personal use and it does not belong on schedule as it have been found to have medical uses and not highly addictive as was thought back in the 1940's when it was outlawed.

Dessalines & skyewill well said. Time for us to focus on priority areas. We can use some of the savings from this wasted exercise in drug education training and possible rehab grants

You're right on point.The technicalities in this case put aside, the cost of bringing a possession of a controlled substance to court and the subsequent conviction or fine is a dead weight on our law enforcement system.
In short we can no longer afford to take a man off the street for possessing the wrong type of plant, place him in a police car, take him to the station, process him, then prosecute him in court only to fine him $200.00. This arrest and prosecution cost the taxpayers at least $1500.00 (a conservative figure)
In terms of violent crimes for every marijuana possession arrest, officers and vehicles are being reassigned to victim less offenses when they could be patrolling or responding to urgent criminal offenses.
Not to worry, because once the US and Britain start decriminalizing cannabis like some US states have done our monkey see monkey do leaders will surely see the light and follow suit.

The man should not have been in jail in the first place. He got preferential treatment of course because of his position but I say more power to him. The weed was not certified, a very nice defense and certainly a loop hole. Now if they want to continue prosecution in this area of the law they will have to provide the court with a certifying official who must be an expert trained and certified in science. Time to decriminalize it and focus on organized and violent criminals.

It grieves me to realize that police corruption is at work. All these mistakes may look legitimate to the unsuspecting person,but they could well be by design to make any case go away and the people walk away unpunished.Trus t me,the act of police misconduct - the misuse of police authority for personal gain - if not dealt with properly,will prove detrimental to this nation in the long run.
