King Loses Appeal

Leroy KingAntigua St John's - Leroy King is again facing the prospect of being sent to the United States to face criminal charges.

On Wednesday, the Court of Appeal dismissed his applications for an appeal hearing and for a stay of High Court Judge Justice Mario Michel’s decision to commit him for extradition. The court confirmed Justice Michel’s ruling.

King’s attorney, Dane Hamilton QC, had argued that Michel and the magistrate, in the first instance, had no jurisdiction to commit King for extradition.


Hamilton, in reply to an argument by Director of Public Prosecutions (DPP) Anthony Armstrong that the Court of Appeal has no jurisdiction to grant a stay in this case, said there was no rule of law that limits King’s application to the court.

Armstrong contended that after the minister of external affairs decides whether King will be extradited to the US to stand trial, he can then file judicial review proceedings.

Armstrong described King’s application for a stay as an abuse of the process.

The Court of Appeal agreed with all of DPP’s arguments and the authorities he cited to reinforce his case.

The court disagreed with Hamilton’s submission that the court did not have jurisdiction to commit King.
The court said this was evident by the judge’s ruling and decision to commit King on 11 of the 21 counts he was indicted for by the US government.


King, the former head of the Financial Services Regulatory Commission (FSRC) and others are linked to financier R Allen Stanford’s $7 billion Ponzi scheme. The Securities and Exchange Commission (SEC) is alleging that King committed wire, mail and securities fraud, and conspiracy to commit money laundering.

Come on!! when the little poor boys in Antigua are caught with their hands in the cookie jar, they face their accusers, cry, and willingly go to whatever the judge/magistrat e states.

There is no rich friend, lawyer or politician advising them or secretly passing suggestions to them how to beat the charges from "due process".

But, yet only in Antigua, can those who have the friend & company hide and wiggle themselves from charges of the courts due to due process.

Go ahead, the more you wiggle and wink-up tells that you have something to hide and don't want the U.S. to let the Antiguans and Barbudans to know from your own mouth.

But, sooner or later, someone is going to get fearful of what you have to reveal and then they going to put you in a corner by your little-self and then you will ask "if its me one that must face the music?"

Boss!! Big Wall Street Employee!! Get yourself to the US or talk now and fast.

King be aware of the long arm of the american legal system. And they never seem to forget either. You may run now, but you cannot hide. If I'm not mistaken there was an Antiguan who had something to do with the airport security and was in Trinidad when he was arrested. Then there was Mr. Cooper who was arrested in Barbados. there was this film producer that ran for years hiding in France untill he went to Switserland and was arrested for something he did over 20 years ago. You name it King better face the music now and get it over with. If you were brave enough to do the crime you have to be man enough to do the time. farewell see ya in 10 years or so.

@ cool ruler...the DPP does NOT charge anyone. the police are the ones who do that...the DPP advise them whether or not to do so and he also decides whether a case, after someone is charged, can be prosecuted based on evidence provided by police...

What was the context I may have made those comments, the link is clickable. In any event if I took that position over a year ago it certainly does not mean I cannot have a different opinion today. I am sure if I did hard I could find instances post by you that may appear to conflict with another you may have made, so in the words of Winston, "what turns on that"

It's a very interesting question one I never thought about. Why was he not at least charged by the same DPP who is leading the effort to extradite him. Maybe he did not think he could win or perhaps king would have used the Asot defence about being tried in two separate jurisdictions for the same crimes

This is turning into another Antigua Farce. Really people, just how long does it take to extradite somebody under Antigua law?

3 Years and counting and it appears we are still no closer to kings extradition, IS THIS REALLY JUSTICE!!

Don't be surprised when people start pointing their fingers and accusing the government of deliberately frustrating his extradition, there's only so much BS the US can take!

Antiguan Abroad well said. I too have found myself wondering why we are taking the lazy route of not charging him. In matters like this that were taking too long, all the governments did was to threaten possible local prison time and these persons quickly accepted the US trip (eg St. Kitts with Noel "Zambo" Heath ) The evidence indicates that King clearly broke our laws, yet we are willing to have another country deal with a person who may have probably committed more damage against this country.

King is becoming more than a bit of a nuisance and an irritant.....be a man and face the charges in the US and defend yourself. Stop hiding behind bogus "legal" (and I use this term reluctantly) arguments. I have a rhetorical question for his attorney....if the local magistrate and high court judge do not have authority or "jurisdiction" to commit his client for extradition, who does? No one, right?? All of this expense of wasting public resources to litigate these extradition hearings could have been avoided if King had been concurrently criminally charged by the Antiguan authorities and given the option of hard prison time in the US or Antigua. Given that choice, something tells me he would have voluntarily surrendered to the US authorities a long time ago.

Lero King is abusing the legal system, by trying to manipulate it into preventing him from legally being expedited to stand trial in the United States. Mr King is an American citizen with an American passport, as such he is subject to American law! He should stop wasting our tax payers money by stop the court actions and go back to his other home and face the accusations alongside his blood brother Alan Stanford. Maybe they can have adjoining cells!
