Government Abusing Legislation – Lester BirdAntigua St. John’s - Leader of the Opposition Hon. Lester Bird has reiterated the Antigua Labour Party’s position that government is abusing the “omnibus” bill passed by the ALP government allowing for any administration to borrow money and undertake capital projects without consulting with the Parliament.

Bird said the ALP has generally maintained the position that all projects undertaken by the government must be brought to the Parliament for debate, despite the provisions of the bill.



“They all need to be brought to Parliament for debate on whether it is best value for money,” Bird said.

He noted too that all documents governing the project agreements must also be submitted in their entirety so that proper debates can take place and more informed positions taken.

“We are asking for these documents and we are expecting that when they come to parliament that we will be given all the documents. They (government) have a tendency now to give you only part of it,” Bird said.

Responding to Prime Minister Baldwin Spencer’s announcement on Thursday that the UPP Government would “soon” table in Parliament the document governing the New Airport Expansion Project, Bird said this, like many other projects should have been tabled before the project started, especially considering the fact that not many capital projects are currently underway.

He said the ALP had not officially requested the documents for this particular project but it has long taken a position that all government undertakings must be brought before the Parliament.

“If they don’t do it we are going to go to Alister Thomas and see if he will justify his position. These documents need to be there so that we can make informed decisions and take firm positions,” the opposition leader said.

Furthermore, Bird said Prime Minister Spencer and his government are using the legislation passed by the ALP as “a cop out.”

He outlined that the bill in question was passed at a time when the Antigua Labour Party government had undertaken a series of back-to-back projects. But despite its passage, provisions were made under the Finance and Audit Act that the information should be brought to Parliament.

“Notwithstanding the bill, the ALP still went to Parliament and ensured that the Tenders’ Board was involved. We passed that Act as an enabling Act whenever time came for specific projects.

“You have to go to Parliament still. We need to know as parliamentarians, with specificity, what is going on,” Bird said.



The opposition leader pointed out that the bill in question sets the parameters in which money can be borrowed, but there is still the need for the government to go to the Tenders’ Board and even to Parliament so that there is a chance for the bill to be debated.

“You can’t go willy-nilly and borrow money without giving the ultimate authority (Parliament) the opportunity to discuss it. They need to come before the Parliament,” Bird said.

How am I being silly,Tenman? I was only responding to what was in front of me. I didn't know about the finance and administrative act passed by the UPP Government in 2006. Oh,well, In that case(If the Prime Minister was in violation of such law), Shouldn't you be saying Lester Bird is silly for arguing about the "omnibus" bill that's no longer in effect when he should be arguing about the law that the Prime Minister violated? I mean,he would be arguing sensibly if he had taken that position.

Tenman, well said indeed! It's a pity that some of us are willing to look pass the law of 2006 and focused on other things! The Law is the law, anyhow you want to twist it or turn it! The question some of us need to answer is: why the PM "broke" his own law? The people didn't asked for these "capital projects," niether were they "consulted" on them! And, worst of all parliament didn't "approved" them! Yet, the PM don't see a problem in "deceiving" the people because he can always blame the previous government for all his "massive-borrow ings" and not follow the law! Tenman, isn't this a game of "follow the leader" or try to "outwit" him?

SlyThatGuy, you are being silly. The finance and admin act passed 2006 (BY the UPP government), makes it clear that such loans must be approved by parliament. It overrides all prior related laws. The PM himself recently admitted that they had no intention of breaking the finance and admin act, but circumstances forced them to now be claiming refuge from a prior law. The PM in 2002 when the law was being debated argued against it and at the time it was explained to him that his then and current interpretation is wrong. Why pass the finance and admin act 2006 if the plan was to ignore it and simply refer to a prior act? This saga seems like hiring someone to fix a problem, and after establishing new rules, the new contractor then wants to revert back to an expired contract.

Everybody who can understand knows that Lester Bird's argument that "all projects undertaken by the Government must be brought to Parliament for debate " is rubbish. How can you have two existing laws, one calling for all projects undertaken by the Government to be brought before Parliament for debate,the other allowing the Government to undertake projects without consulting Parliament? Where is the logic in that? You don't give people any options if you want them to abide by a set rule and then blame them for doing otherwise.

What Lester Bird is saying about the UPP Government abusing Legislation is just nonsense. He himself passed that same "omnibus" bill when he was in power,which gave his Administration the freedom to borrow huge amounts of money and undertake capital projects without consulting Parliament. He enjoyed it then,but now he wants to arbitrarily change the rules for the UPP Government.

In 2004, we were told that the "wrongs" will be "right!" It turns out to be a "slogan" of "empty" rthetoric and "broken" promises for many voters! The PM has shown the people that "promises are a comfort to a fool!" Besides taxing us "mercilessly," he has "barrowed" more money and wasted a lot more on projects! By not going to Parliament for approval, the PM has broken the very laws of the land he himself promised to obey! Why do we even have measures in place to combat "borrowing" on capital projects, if we are not willing to follow it? I am of the view that these "infractions" on the taxpayers money will always be there, regardless of who is "guarding-the-s hop!" Today, we have seen the GOAB "abuse" on the public's kitty, as loyalty to party-hacks benefitted from these projects! And, unfortunately, we have seen how the Loyal Opposition has been "blind-sided" by the Prince's love of "trickery" and "deception!" Where is the "Pledge" by our leaders to stamp-out corruption, cronyism, nepotism and deception?

In the picture we see Baldwin Spencer proudly standing on land he does not own illegally building an airport on land he does not own.

WHAT KIND OF MESSAGE DOES THAT SEND OUT TO THE INTERNATIONAL COMMUNITY?

A PM who does not respect his countries own laws and has yet again expropriated land is seen smirking on the front page of a Caribbean paper. It should make us all ashamed to be Antgiuan!

As in the case of the Medical Benefits Scheme, The Mount St. John Hospital etc, the subordinates like Meade will go to jail, but those like H. Humphreys only pays a fine from their xxx-xxxx accounts.

Greetings, Of course Lester is going to complain. The UPP had vehemently opposed this piece of legislation when it was been debated in Parliament. However, now that they have control of the Nations finances, they are using this same Act to justify the abuse of Our money
This is the way WE allow these **s, gangstaz from both parties to keep on robbing us blind, while them and their cronies get away with it.
