Government To Fork Out $40K To ABEC Duo

$40K To ABEC DuoAntigua St. John’s - After receiving their letters of reinstatement, Karen Manwarren, senior registration officer at the Antigua & Barbuda Electoral Commission (ABEC) and Administrative Secretary to the Supervisor of Elections Eren Francis have each been awarded damages to the tune of $20,000.

A High Court judge on Friday granted the order after the sum was agreed to by the parties.

Both women were seconded from ABEC into the government service following a Cabinet decision of November 23, 2010.



Manwarren and Francis opined that the move was illegal based on the Representation of the People Amendment Act of 2001, which states that all decisions of the Commission, including employment, must be free of political interference.

The applicants (Manwarren and Francis) filed legal action against a number of people, seeking to be placed back to their substantive posts.

Named in the lawsuit were Prime Minister Baldwin Spencer, the Cabinet of Antigua & Barbuda, the ABEC commissioners Chairman Juno Samuel, Deputy Chairman Nathaniel “Paddy” James, attorney E Ann Henry, Anthonyson King, Paula Lee, David Kelsick and Glendina McKay, as well as former ABEC Chairman Bruce Goodwin.

The parties initially could not agree on an appropriate award for damages. Offers of $10,000, $25,000 and $20,000 were made.

Sir Gerald Watt QC wanted $50,000, the maximum sum for his clients. He reduced that sum to $40,000 and then stated that he was willing to take $35,000.

Justice Thomas Astaphan told Sir Gerald that he did not find the $25,000 being offered by Attorney General Justin Simon QC to be unreasonable.

Watt felt that both women were treated badly and were therefore entitled to more money. The judge urged him to accept the offer and added that, “On my reckoning it would be less.”

All parties later agreed to the $20,000 figure.

In a consent order it was agreed that the Electoral Commission acted unlawfully in seconding both women to positions in the public service of the government as a result of a decision from Cabinet.

The applicants are to be returned to their substantive positions effective December 8, 2010. An order of certiorari quashing the secondment of the applicants from the Electoral Commission to positions in the public service of the Government of Antigua & Barbuda was also ordered by the court.

The Commission is prohibited by itself or through its agents from removing Manwarren and Francis from their substantive positions without just cause.

If the parties fail to agree as to costs within 14 days, costs will be decided in line with the Civil Procedure Rules (CPR).



Attorneys for the applicants asked for interest on the damages but the court declined that request.

Justice Astaphan commended the attorneys for arriving at an amicable resolution to a matter which he said was “pregnant with controversy”, and that within 24 hours.

The attorneys thanked the judge for his kind words and helpful suggestions.

Attorney General Simon represented the Cabinet while Sanjeev Datadin and Sherry-Ann Bradshaw appeared for Spencer and Goodwin. Patricia Simon-Forde appeared on behalf of the Commission.

Dr David Dorsett assisted Watt in representing the two ABEC employees.

Sad that individual poliutician are not held accountable

It is sad that bad management and bad decission are not punished by having them pay for their obvious mistakes. In the private sector this would not be tolerated. This $4oK could go towards paying pension or paving a road. But ofcourse they don't feel it and we Antiguans don't stand for anything. That is why they the politician consider the public purse theirs. The raid it as they please and nothing ever happens to them. Shame shame shame, what a dog gone shame. Not proud to be an Antiguan. :sad:

Why is a young promising lawyer like Ms Bradshaw damaging her reputation, taking all these cases for BS which are doomed to failed. I definitely would not be going to her for representation cause from the looks of things, she sure seems about the money and not in proper advise. Tell dem when them wrong and stop waste our scarce resourses!!!!!! Ms Bradshaw consider your ways and be wise....

It should not be the Govt that has to fork this out,it should be Baldwin Spencer and Bruce Goodwin, The tax payers had no hand in it,Why should we pay??

This is how these board led organizations in this country are run. The leaders do not think that they are accountable to anyone so make executive decisions without thought. Like one academic director who scheduled an hourly paid part time lecturer at a local institute to work 27 hours a week up from 12 hours a week without consulting the human resource manager, accountant, or Executive Director to see if the school could pay for it. The he distances himself from the lady when the Executive Director refuses to pay her as if she scheduled the hours for herself. She too will win in court one day and the institute will have to pay her. The same institute changes a grading system in the middle of the school year without any written warning, seriously disadvantaging the students. They too will have to pay when their accreditation is brought into question when foreign colleges see the anomalies in the students' transcripts. But that is how we do things in this country - the people in charge don't care because the money does not come directly from their pockets.

At the risk of being repetitive to my fellow bloggers Chef has to comment.
40.000 today how much so far?( half moon bay, Stanford) and how much more to come?
If the UPP and DR2PMBS had any soul he would write a personal check and put an end to having the taxpayer pay for his utter ignorance of law , governing and life in general?( note chef said soul, the search for Dr2PMBS brain has long been abandoned)
at least this money is going to Antiguans and as such chef trust it will find it's way back into the local economy.

It is just a pity that the compensation (which is well deserved) is going to come from the public purse. But God is not sleeping. Judgement day is coming for all them politicians who believe they can do stupidness just because they are not paying from their personal funds. Judgement day is coming.

When will it end.We must always remember that there is a God above, he never slumber or sleep. We all heard the slogan what is wrong will be made right, and what is right will remain right but this Govt. has done so much wrongs against the citizens. The road to deliverance seems long and hard but the God above will see us through. May God bell us all.

I am very surprised that E. Ann Henry, being a lawyer of some repute and experience, would accept her commission without checking the legal case before the said commission. I guess some people are all about supporting their Party and Patrimony? What a shame.

I hope she reads the above article by John French II.
