AG Response on MOU Raises Questions

Attorney General Justin SimonAntigua St. John's - Attorney General Justin Simon has replied to reports on Caribarena that his office was not consulted prior to the creation of a policy directive by Cabinet to the APUA Board of Commissioners to sign the Telecommunications Memorandum of Understanding (MOU).

The AG said that Caribarena's article “Killing the Free Market” is "replete with inaccuracies",

and questioned whether Caribarena had been deliberately misled by its sources, or whether Caribarena had chosen only to cite specific portions of information.

According to the AG, APUA's Directorate and Management were invited to Cabinet on the 18th of June to identify any major issues they would have, and that lawyers and technical personnel of all the parties had participated.

The AG further clarified that the cabinet directed the Attorney General's office to vet the MOU on the 18th of June, and that the negotiation of the MOU was a lengthy process which took several months.

However, the AG confirmed that his office had not been invited nor been involved in the negotiations of the MOU (aka Memorandum of Agreement, MOA), and that following his office's response on the 20th, talks with APUA and subsequent changes to the MOU were made, which were accepted by all parties.



According to the AG, his office's contribution would have been limited to legal and not technical matters even if they had participated.

The AG closed his response by denying that the MOU creates a cartel, without providing any specific reasons supporting why he is of this view.

This response raises several new questions.

On the 15th of June, APUA's attorney requested the advice of the office of the Attorney General on several matters pertaining to the MOU (see Letter 1).

On the 18th of June, the Cabinet issued to APUA a policy directive to sign the MOU (see letter 2).

Why had the Cabinet issued this policy directive to APUA and simultaneously directed the AG's office to vet the MOU?

It was only on the 20th of June that the AG's office replied, stating that it was not part of the negotiations, that it was the first time the office had examined the MOU, and that it took issue with several aspects of it (see Letter 3).

Why would the Government not instead have waited for this response from the AG's office, and then instructed APUA accordingly?

Also, why does the Attorney General insist on referring to the MOU as an MOA (Memorandum of Agreement), despite the fact that the Cabinet letter to APUA specifically instructs the statutory body to sign an MOU (Memorandum of Understanding)?

Maco my understanding is Johnson is the lawyer for APUA and also the board secretary.

Who is the secretary to the board of APUA? Isnt it Mr. Lenworth Johnson ? Is the law firm of which he is a part doing private work from APUA? If so, isnt it conflict of interest?

Your comment is ignorant, unwarranted, and demonstrates the extreme problems our country is facing. THERE IS NOTHING ILLEGAL ABOUT RELEASING THIS INFORMATION. APUA is a public company! All of their documents are public property! It's not like caribarena is releasing the future plans which could give APUA competitors an advantage! Your comment is trying to make it sound like releasing public information from a statutory body is illegal, when it is NOT. The people have every right to this information. It is the Government and it's workers who should be afraid, and who should be consulting lawyers, because they are hiding the truth from the people, and they deserve to be punished. keep going Caribarena!

Caribarena,as a lay man,not a lawyer.Be careful how you publish information.I would caution you guys and gals to vet your information.Mak e sure a lawyer give you the okay before you are caught up in a tangled web.If someone is leaking information to you,protect that person's indentity.Based on information, hotel 1735 is not a nice place to visit and or reside.I have never been there and have no intentions to go there.

I have read, and re-read the article as well as the comments. All comments suggest the AG has not done his job, or been neglectful; however the article suggests to me that the Left had does not let the right had know what it is doing and is simply flying the the seat of its pants, how can this possibly then become the fault of the AG. It is clear to me that the responsibility lies elsewhere in this matter. It is obvious that this arrangement was handled in haste. APUA & Government should have been not only looking forward to this day, but planning for it. Fail to plan, Plan to fail.

Thank you Caribarena for all the letters. The AG obviously did not know that you had the evidence and he walked right into the trap.
But who should be surprised? Mansoor and Shoul rule and Justin and the rest of his colleagues follow instructions. They know who **ers their bread.

Having read both letters and the sequence of events you have outlined Caribarena, I do not see how the AG's response to your previous article is rationally justified. Expect for optics and cosmetics, the AG should use his high office for more noble deeds. I am sure that local politicians sincerely feel that talk is serious action. The AG's response muddy the water more than it makes it ready to drink.

This response by the AG is nothing more than plain "lip service"! I guess he didn't anticipate your possession of the said correspondence?

Looks like we may need another inquiry?

Justin has embar**ed himself and his "lofty" office with his response!
