Prosecution Looms for Financial Abusers of Elderly

Antigua St. Johns – Social Transformation Minister Willmoth Daniel is warning relatives and caregivers of elderly people that they can be brought before the courts if they continue to exploit them financially.

He said that in many cases those who have care, custody or stand in a position of trust of an elder or dependent adult are misappropriating their money or property with the intent to defraud them.

“We are in the process of drafting a document for Cabinet’s approval to at least in
the first instance manage the financial benefits of persons living in institutions in Antigua & Barbuda,” Daniel said.

“For too long, relatives and caregivers are signing for these cheques and utilising them for different purposes.”

One of the minister’s main recommendations is that the benefits of institutionalized seniors be transferred at source to the respective government agency that assists with their care and well-being."



It is appalling that these cheques are signed for by persons every month and the beneficiaries do not get a penny from it and the state is left with the care burden of the elderly.

“Most times these caregivers spend the moneys foolishly to fix hair and nails, while the
elderly who have worked hard and should be enjoying their golden years are left to languish at the mercy of the state. This practice must be stopped once and for all,” Daniel said.





“We are very serious and take a zero tolerance approach to any form of abuse against our elders and legislation will be put in place to curb the illegal practice.”

The minister acknowledged that financial abuse of elders and dependent adults is a growing problem, and called for the community and the police to take an active stance against the practice.



He also urged relatives not to abandon their elders or place them in institutions.

 At the same time, Minister Daniel commended those who take care of the elderly and utilise their resources responsibly.



Meanwhile, Junior Minister in the Ministry of Social Transformation Senator Malaka Parker said that “financial abuse is one of the most under-reported crimes due to victims’ embarrassment, fear of loss of independence, intimidation by the perpetrators and widespread lack of awareness that it is a crime.”



Research has shown that victims of elder abuse, neglect and financial exploitation are 3.1 times more likely to die at an earlier age than those who are not victimised.



Today, as Antigua & Barbuda joins in the worldwide observance of Elder Abuse Awareness Day, residents are encouraged to wear yellow to show that they stand in solidarity against all forms of abuse against the elderly.

Kudos to the MP? What a laugh! might as well enjoy the laugh before the Crying starts. because after these UPP Gangsters get their hands on the Seniors financial benefits they wont stop there ,their Estates will be next, and lots of tears will fall. these Health Care facilities are needed, and sometimes like clinics and hospitals workers get sloppy and the families will be outraged, but these problems are quickly corrected. so to the relatives 'be vigilant.and demand good services.

Steadyj, I agree with your post for the most part. However, the part that is troubling to me is the following: “We all know that Granny and Grandpa have their favorite relative or family member to handle their finances. Hence they will authorize such persons to be their "representative payee"(the person who cashes their checks for them). So if a representative payee wants to go drink rum, buy a car, or get their nails done with the money, where is the crime? The person may be [scumbag] not a criminal.”

Steadyj, with all due respect, I believe that that statement is irresponsible. The “representative payee” is a fiduciary – i.e., “a person to whom property or power is entrusted for the benefit of another. This is based upon or in the nature of trust & confidence.” To use the money for anything other than for the benefit of Granny & Grandpa is a violation of the fiduciary relationship and is prosecutable.

My granny can get she money directly and til give me. Some elderly folk just like to spoil their grandchildren. Not everyone is out to defraud the elderly. Now as for politicians . . . .well that's another case.

The Government is cognisant of the need for care facilities for the elderly, why not do something about it . The Old Nurses Hostel is being used for a mass camp, there are many two bedroom and one bedroom quarters there, why not offer this as an alternative care facility . Those relatives who opt to put thier loved ones in this facility if they cannot afford the private daycare centers will then assign all payment to that care facility if the elderly person is no longer competent to make decisions. I believe the cases where people rob the elderly are few. Day care centers range form $1800 to $3200 per month, many well meaning relatives cannot afford that nor do they want to humiliate their loved one by placing them at Finnes institute. Employment will be created for care givers , cooks , clearners , counselors etc. Think outside the box Mr. Daniel dont just stir up emotions actually do something worth while.

In part 2 & final of a post dated 2/6/2012, in reference to the article “Hospital Residents Living in Filth”, I said in part; Quote:
“the institutions should not be handing the patients’ social security payment over to family members while the patients are in the institution. I believe that while the patients are in the institution, any social security payments should be used to defray the cost of care. By doing this, the patients will receive better care and housing instead of family members utilizing the funds for their own selfish purposes.”

I am heartened to learn that some effort will be made to properly utilize the funds of the elderly and the disadvantaged. Kudos to the MP!!

Its general practice that when an elderly person is institutionaliz ed that said facility should get whatever subsidy for the person that is in their care. For example if a person is in the Fiennes Institute, Poor House should be the payee for that all that persons benefits such pensions from the USA, the UK, and Canada, as well as local benefits. Don't agencies such Social Security do audits on recipients, where they bring them in the office to do an annual review? Or do they just send the checks out blindly?

I think that Mr. Daniel should draft legislation and take to the parliament, so that it can become the law of the land. He should not be casting aspersions on anyone. We all know that Granny and Grandpa have their favorite relative or family member to handle their finances. I totally agree with the Minister's stance on this issue. I read somewhere recently that the family are allowed to cash the elderly relative's cheque while they are in a government institution such as the Fiennes Institute. This is outrageous because all the cost is borne by the tax payer and the family are still benefiting without taking any responsibility. The government should look at this issue. All cheques should be signed over to the Fiennes Institute for the upkeep of the elderly person. Correct me if I am wrong?

Tht would be a very good move. I'm 28 and sometimes wen I see de elderly folks it breaks my heart. After I've worked hard for so Many years will tht be me?
