Lawyer Says Airport Construction Illegal

Antigua-Airport-ConstructionAntigua St John's - The attorney representing Stanford Development Company (SDC), Hugh Marshall Jr, has said construction of the new VC Bird International Airport terminal is forging ahead illegally.

Marshall said the government is working unlawfully on lands that still belong to the SDC, since negotiations for its sale to the state have not been finalized.

Speaking with Caribarena.com on Friday, Marshall said the company has long since taken legal action to prevent the government from using the land, but these orders are being ignored.



“The government is doing its own thing. There are existing orders that have been in place since July of 2010,” Marshall said.

But while the attorney complains, the receivers appointed to manage the liquidators of Stanford assets said although the SDC had informed them of the potential sale of the land, it is yet to provide an update on the proposal and what is being negotiated.

The receivers also agreed that the lands cannot be sold without their explicit permission, and anything outside of their permission would be illegal.

Hugh Marshall Jr believes, though, that the receivers’ taking such a stance is a gross misrepresentation.

“That is a bit surprising to me, because when I was first approached by the government in relation to the land, there was a letter from the joint liquidators agreeing to the sale of the land at what I would consider to be insignificant value," he said.



"So I am very surprised that they don't know of the transaction. They have been informed… They have been kept informed.”

He added that if the receivers have not gotten any updates from his office or the officers of the SDC in Antigua, it is likely because “maybe none has been warranted”.

Marshall said if the receivers believe they need ball-by-ball updates “all they have to do is ask”.

Responding to statements from the receivers that the sale of the lands is illegal without their blessing, Marshall said there is already a court order in place that governs the transaction.

“There is an order and the government has to fulfill their obligations under the order… it is not a sale by private treaty,” the attorney said. “The liquidators have possession of that order. They know what the terms and conditions are and what the negotiations are about, and if they are saying otherwise, I do not believe it is accurate.”

Attorney General Justin Simon provided Caribarena.com with a “corrected” draft court order that, according to him, Marshall said he would be filing subsequent to signed government approval.

He said, “The judgment debt in favour of APUA is more than sufficient to cover the purchase price of parcel 72, which is the taxi stand, and urgently needed to commence the construction of the new terminal; parcel 71 is the former government car park…”

Simon added that the judgment debt could be confirmed by APUA’s attorney, Lenworth Johnson.

Further, the AG said he expects that the other debts would be settled this week.

The government had proposed settling the cost of the land against outstanding monies owed to statutory bodies by the SDC.

“I have forwarded Mr Marshall the figures from the various statutory boards and in respect of property tax," the AG said. "From my calculations, the cash balance would be less than a million dollars."



In the meantime however, Marshall maintains that the ongoing construction at the airport is illegal and that the government continues to do what it wants in spite of the orders against them.

He did not say what further legal steps the SDC would take to the courts once again to stop the construction activity.

What I don’t understand is why the government doesn’t just use its prerogative powers and compulsorily purchase the land!!! And if they believe they should not pay up, well just say so and give legal reasons and or justification for doing so????

Who pays Marshall's legal fees? Why is SDC in business?

Who is paying Marshall? Stanford in Jail these days and for many more to come. SDC was formed with stolen monies so why is it still functioning? shouldnt it be seized? The government should not pay one penny more than SDC paid since they are only returning stolen goods but they should pay the victims since SDC needs to be shut down.
Marshall needs to go find a job his client won't be paying anytime soon, SDC needs to stop functioning here in Antigua and every where.

Any money owed SDC should be divided by the liquidators among ALL Stanford creditors, not just a few ex employees.

Was there not a court order that the government should pay SDCL outstanding ABST to the tune of over $20 million. I believe SDCL claims they are waiting on these funds in order to pay the staff their severance pay. Well Mr. PM please pay SDCL so that we too can get paid. All our savings have long dried up and still no job out there for many of us.

This could all work out for the best. Since the Stanford victims will be the owners of this new airport, they can impose usage fees to eventually recoup their investments.

It's awfully nice of the Chinese to help them out with that.

Time and time again, its shown that government does not respect even laws the current government pass. Examples are the trilogy of legislation, the finance and admin act. If government will not proceed according to law, does it not see that it leads in the wild wild west mentality which pervades our society?

On one hand, your right. It is certainly aggravating that the government should have to stop and wait for all this permission nonsense, especially with a large project like the airport. On the other hand, you are wrong.

If the government can simply choose to build wherever they want, what is stopping them from tearing down YOUR house and building anything they want on YOUR LAND. and the answer is nothing. The Government needs to respect the law, and can't choose to just build on land it doesn't own, even if the sale in already in negotiations.

I, for one, just want this whole stanford fiasco to end. The number of conflicts of interest and corrupt interests that stanford's business gave birth to is unfathomable.

It is outrageous how Spencer and the UPP allegedly violating Antigua's laws and disregard the courts orders to stop building on airport lands they do not own.

How could any international investor trust a government that breaks the laws of that country and ignores court rulings. This kind of action deters all potential foreign investment from coming to Antigua.

Time and again we see how Spencer and the UPP set themselves above the law. The purchase of the Chinese generators that never went before parliament for approval, Building on airport land that does not belong to you are just the tip of the iceberg.

Spencer's refusal to hold an investigation into those generators is the most damning evidence of all that he places himself above the laws of the land and the wishes of the people.....a Dictator!

Why should the government delay the process, and the airport is necessary for Antigua & Barbuda development. Whose financial interest is stake, only the legal luminary knows. I guess when theft is legal, laws should be established to determine who ultimately gets the stolen property. Apparently Sir Allen's team didn't address the issue when writing Antiguan banking laws.

This blatant disregard for the standing/bindin g order is very troubling. How can the gov't, in good faith, require citizens to be law abiding if they themselves do not follow the law(s). The sad thing is that in the end it is the good citizens of ANU who will be paying the legal costs for the stubbornness of our leaders. My gosh! When will the nonsense stop?

I'm surprised that the Chinese, having been bitten once with the power-plant fiasco, would have insisted that this "deal" go before Parliament for discussion and ratification?

Of course that's not how business is done in a one Party State! I guess PM BS and Shaolin are both thinking this is a one Party State too?
