Local Doctors Weigh In On Sick Leave

photo- hrlegalnews.comThe Social Security Board and the Employers Federation will be tightening up on the abuse of sick leave, which has been a complaint from employers for some time.

They have expressed concern that certain doctors' signatures have been showing up on the certificates of workers who have been taking what they consider “illegitimate” sick leave.

While representatives of the organisations made it clear that they did not intend to bring the reputation or professionalism of doctors into disrepute, one physician noted that a broader view of the issue was needed, although he too has heard of reports where sick leave is being abused.

“I don’t know if I am in the set of doctors whose signatures are turning up more regularly on the medical certificates, but there could very well be a logical reasons for this," he said. "For instance, I see more patients than many other doctors in this country. From the time I arrive in the office at seven, I see patients right down the line.”


He added, "The doctors they have identified may be the same doctors who are seeing the majority of the working population, whereas a district doctor sees patients 15 years and below, and 60 and above, so there might not be much coming from them. All these things must be taken into consideration.”

He was however quick to appeal to any of his counterparts who might be engaging in anything dishonest to stop immediately.

“The thing about it is, as a doctor, there will be people who will come to you with all sorts of issues, and you have to take decisions that will not compromise your profession," he said. "Nobody can pay me for a sick leave. If you are sick, you are sick, and I will give you the amount of time that I think you can use to recuperate. Now some patients who know that they can go to a particular doctor and are guaranteed sick leave would often brag about it. They will talk, and this embarrasses the doctor. Sometimes, you may get in a dispute at work and the first thing that person will say is, I’m going for a sick leave. These things are not to be encouraged.”


"Some patients choose not to come to my office because I stop them in their tracks on these matters," he added.

A specialist in internal medicine said he was also concerned about the allegations, as general practitioners usually outweigh the specialists when it comes to issuing sick leave.

“You would definitely see the general practitioners approving more sick leaves than a surgeon, an OBGYN, an ENT... and these sick periods will last for a longer term, for obvious reasons," he said. "I think if there is an issue with regards to the legitimacy of sick leaves, company managers or the authorities can seek recommendation from a second doctor to put these concerns to rest."

Morris I am told before you can save a drunk they need to first hit rock bottom until then they will be in denial. I read a quote today from Tim Hector which he wrote in an article in 2002 that sums up our present predicament: ""Of course we will continue, in insular patronage and corruption, hoping that in the tradition we imbibed from British colonialism, we will muddle through. It will not happen."

Honestly I suspect this is more a Human motivation issue. You really cannot force a doctor to ignore a patient who says they feel ill. The doctor has to give the patient the benefit of doubt unless he 'she has evidence to the contrary. Employers need to find better ways to motivate their employees to be present when they can. We have developed an attitude of hostility where employees feel they are being taken advantage of and employers feel their scarce resources are being wasted. Perhaps a better solution is to find a HR consultant who can examine this issue in the effected industries and offer some solutions on a way forward.

The employers need to pay more attention to the health and wellbeing of their workers. These are the people who make them rich.
I have seen articles talking about bad work conditions in schools, banks and other offices with their super cold AC and other health hazards. Hotels are notorious for their wet floors and some cheap short cuts that are hazardous.
The employers just keep failing to address these situations.
It seems that SSS is going after the employers for non payment so the employers want to blame doctors.
Please leave the doctors alone.
Remember if a patient is so stressed out that it is affecting their work performance that also constitutes illness.
Treat your workers better and there would be less sick leaves.

When ever a person goes to the Doctor, the Doctor ask that patient what is wrong, the patient tell the doctor, no doctor can not tell his patient that they are not sick.

Service workers are the main ones who are being accused of abusing sick leave but I am not convinced. Have you seen how a waitress or housekeeper looks after 10 years in the service? They often walk sideways and have their ankles and knees banded. They suffer from arthritis and back pain. Sick leave is due to the nature of the industry; the poor working conditions; back to back shifts, split shifts; resultant lack of adequate rest. It also has to do with the stress which comes with the job. I am not convinced that there is any abuse of sick leave but we need to look at what is causing the hypertension and diabetes experienced by so many hotel workers. Maybe it is the poor nutrition they get in the work canteens.

Additionally, to get benefits in the US for Social Security because of illness, you literally have to have one foot in the grave and the other food on a banana peal (emphasis added).

In any program there is always some abuse. The hope is to catch it and curtail it as much as possible.

As I have previously said, sick leave should not be handled by the Social Security Program. Sick leave should be handled by a “workers compensation program” or a short term or long term disability program. This would require the companies to pay a premium to the fund the workers compensation program to cover injuries on the job. Companies should offer short term and long term disability programs, for which the premium could be shared by the company and the employees to cover illnesses unrelated to work. SIC anyone?

Now based on the above, if a company suspects that an employee is abusing sick leave, the employee could be warned. If the patterns continue, the company could have the employee medically examined at its own expense. Depending on the results, adverse actions could follow.

Some people like to refer to the US as a comparison. But in the US, sick leave and vacation times are defined in most company handbooks. When you abuse the policy, more than likely, you will be terminated.

It is a well known fact that there are practitioners of medicine who grant sick leave on request. This has been taking place for years and ignored by the authorities. This problem becomes more prevalent particularly during the carnival period and christmas. Without a concensus among stakeholders to rid our society of these "upstanding citizens" this trend will continue.

I am of the option that I doctor should not indicate what illness his/her client has. It maybe a case were persons are abusing the system, but it is up to the doctor to determine whether or not the client required sick leave. It is an invasion of privacy for company's to request a second opinion.

And who will pay for this second opinion?
