Unions Offer Support to Dismissed Doctor

Support to Dismissed DoctorAntigua St John's - Trade unionist Dave Joseph has said the unions in Antigua & Barbuda have a moral duty to see to it that Dr Leyland Powell “gets his justice”.

Joseph’s comments came after the Mount St John’s Medical Centre's (MSJMC) fired the physician after he voiced concerns about the institution.

“I think this is an important fight not to run from,” Joseph said.

He suggested that the Trade Union Congress (TUC) tackle the matter head-first, in whatever way necessary, even if it means seeking out the doctor and offering its support and advice.

The trade unionist said from his perspective, and taking into consideration the “history of the struggle in this country,” the doctor "should not be left out in the cold in his fight for justice”.


Dr Powell was fired on Monday, with immediate effect, weeks after he went public with grievances about the sleep-in requirement for junior physicians when working extended overnight shifts.

The MSJMC, in a letter signed by Medical Director Dr Dane Abbott and CEO Dr Victor Jackson, said it could no longer tolerate such defiance of its policies.

Caribarena.com spoke briefly on Wednesday with Head of Marketing & Communications for MSJMC, Salma Crump. She said she was busy and could not address questions on the subject. Attempts to reach her again during the day were unsuccessful.

Meanwhile, Industrial Relations Officer Ralph Potter has also expressed his intention to pursue the issue.

He said, “Trade unions, to my mind, have an obligation to stand in solidarity with any worker who has been taken advantage of or mistreated.”

Potter said he had only heard the grounds for dismissal through the local media, but his experience in these matters suggested that the dismissal was unfair.

“The first question that came to my mind was whether or not the sleep-in situation was a benefit for the doctors,” he said, adding that if this was so, then certainly an employer could not sever ties with an employee who refused to use an added benefit.

The industrial relations officer recalled that years ago, in the hotel industry, staff that worked late had sleeping quarters. But he was not sure whether the same situation and terms were in place at the hospital.

“If it is a benefit to say when you work those long hours, we are giving you an opportunity to sleep in, and this is after the hours of work, it would seem to me clearly to be a case of unfair termination,” Potter explained.

He added that, “If that is what it is, you can then say it is part of the benefits of employment, whereby when you work long hours you are given sleeping quarters to recover.”


Potter pointed out that this type of arrangement is commonly considered to be a benefit, and if an employee refuses to partake in a benefit, an employer could not use that as grounds for termination.

“On the surface it would appear as though the dismissal was totally unfair, unless there is something in his contract that might put a different twist to it,” Potter said.

Attempts to reach the former MSJMC physician have proven futile, as have attempts to ascertain whether he has hired a lawyer to address the matter.

As I read all these comments I have to chuckle. Two years ago I went to MSJMC with an extremely sick baby. The emergency doctors tried their best but the baby kept getting worse. Mid-morning they called in a Dr. xxxx. He never arrived until after 8 that evening. By then my nerves were frazzled. In a very casual manner he examined the child and then said he had to be admitted. If this is the same Dr. xxxx I would just like to say that MAYBE there has been more instances of this type of response and so MAYBE the establishment is correct.

Notes From A Native Son of the Rock. Ashamed & Ashamed Too, you are both correct that Dr. Abbott, as an Intern & Resident, was at one of the leading Universities and Hospitals in the World. That Hospital has seen many a Caribbean Doctor in a leading role in many disciplines. Given the high cost of Health Care, such practices were and have been employed in the Developed World to lessen Health Care expenditures. To expect Dr. Abbott to follow another path would suggest that he would go in another direction to what he has been taught and experienced. Doctors unless they are engaged in Research are not forward thinkers. Dr. Powell is a rare medical practitioner. His acumen and sagacity would be appreciated in the Developed World, sadly not SIDS which are confronted with ensuring survival of the fittest. I understand his pain, but one must always understand the Caribbean Sea and the fishes swimming in the deep Blue.
Give Dr. Abbott some credit also. Health Care Costs are balloning worldwide. He may have erred, not based on "ethical badmindedness". This required facilitative leadership and expert coaching for which he was not trained. Much Respect

Jerry,
I want to thank you for your comments. The very sad thing is everyone knows the issues that existed at Holberton and that have been carried over to this new facility. But, just like the political leaders there is no accountability and Antiguans and Barbudans continue to die for issues that should be easily addressed.
People like you, Dr Powell and those who have taken a stand in his support are to be admired. Everyone knows that the issue in not really about sleeping in. 'Smoke and mirrors."

Dr. Dane Abbot...I am very disappointed in you, I know that you worked in one of the best health care facilities in North America and I hoped that the experience there would have given you the courage to stand up for improving the medical history and conditon of Antigua & Barbuda. Shame on you for allowing this.

Caribarena needs to get to the heart of this story. There is too much speculation. We know the doctor was allegedly terminated because he was outspoken about a policy and the perceived unfairness of it. I did not get the impression that he refused to work or "sleep-in". So we need to know what the policy is for "sleep-in" for ALL doctors and we need to know how the doctor violated this policy which put patients lives at risk.

Without knowing more, it appears that this situation is similar to the LIAT pilot who was terminated for speaking out against the company.

Let's fix the little things before we attempt to fix the big things."

But you see what these idiots did? They hate themselves so much and they hate local talent as well that's why they got a Republican lobbyist to take taxpayers money inorder to represent his party's interests. You are either attached to the Management of the MSJMC or you are ill informed. The senior Doctors who have the experience and earn the big bucks are hardly ever there, even though they are paid to be there. The young interns are the ones working the long, long hours for little pay and NO SUPERVISION, which they should be having. A relative of mine died there recently quite suddenly and we were told off the record that the experienced doctors are hardly there. This is where our fight should be. We should be supporting this young doctor who is trying to change this corrupt system.

I know I must be sounding like a broken record now, but Caribarena needs to either drop this story or bring it from the start.
Again people still have a bad impression of Dr. Powell as a defiant, trouble maker who wants to do his own thing.
He is a very kind-hearted doctor, caring and wants to organize young doctors in this country to practice their profession well.
He also looks out for his colleagues and had reorganized the medical association, before the old oligarchs decided they prefer the old obslolete way of doing things. Before that, but especially since then the young man has suffered much.
I thought the people in charge now would have taken hospital care to a new level, but while they were critical of the prevoius medical superintendent at Holberton they have maintained the old ways.
Antigua and Barbuda has enough human and material resource that we can have a first class health system, but it can not happen when vindictive leaders and political victimization is the order of the day.
The sleeping-in issue is only a small part of huge problem.

From what I have been reading of this incident on this site, this Dr.powell seem to be an insubordinate rouge and should remain fired. Doctors on call at a Hospital anywhere in this world stays at the institution,the re are accommodations provided. why should this rouge want to be away from his post while on duty? What if there is an emergency and he is in Freetown? think about this. I applaud the authorities for taking stern action against him. I wish others in authority had the courage to do whats right, only then Antiguans would know that there consequences to their unlawful actions. With this attitude, let Dr powell seek employment outside of Antigua.

I am happy that at least the trade unions are more sensitised to the plight of professional people in this country. And the good Doctor can be assured of my support in anyway I can.
We must support each other, be our brother's keeper. We cannot allow duncy head politicians and their choir to intimidate us and so suppress our conscience. We have a responsiblity to our fellowmen. Professional integrity demands that we are true to the ideals of our profession, there can be no nobler way.
Dr. Powell, you are a courageous leader, dont let them run you.
