Private Schools Outside Ministry Control – Dr. LeandroAntigua St. John's - The parents of children expelled from the Antigua Baptist Academy have the option of applying to the educational tribunal, or of taking the matter to court - if they expect any retribution for the school’s actions.

This is according to Education Minister Dr. Jacqui Quinn-Leandro, who said it is discretionary for a private institution to allow who they want in their school.

“There is no right there. There is a right in (a) public school because that is our mandate. It is up to the school board to determine who they want. That has no jurisdiction with the ministry,” the minister said.

Her statements further validate the position expressed by principal of the Baptist School that since the parents of the expelled students do not fall in line with the ideals of the institution then their children are no longer welcome.

Dr. Quinn-Leandro said however that while the ministry has no jurisdiction over matters like these, it does open its arms to those students who find themselves in such a position.

“The ministry would be willing to accept any child who does not have access to a private school. We have free education primary and secondary,” the education minister said.



She reiterated that based on her understanding of the laws, the discretion for allowing a child into a private institution resides with the board and management of the individual school.

Had the school been government assisted, with a ministry of education representative on the board, only then would the government have been able to exercise any authority.

“This is not a government assisted school. It is a totally private institution. If it were government affiliated then that would be a different matter,” the minister said.

“But if it is that the parents do not fit the philosophical outlook of the school then I suppose it is within the discretion of the school to say so.”

The education minister said further that the parents have lots of options outside of the legal challenge or the involvement of the education tribunal, and those options lie either with other private institutions or government schools, especially considering the academic standing of the children.

Since the education tribunal was established in 2011, only one case has reportedly been brought before it.

Once again, Dr. Quinn-Leandro, you are dead wrong. NO SCHOOL in the island of Antigua can operate without the formal permission of the Ministry of Education. Such permission is granted only after a host of stipulations, laid down by the Ministry of Education are met. By the same token, if private schools fail to follow the prescriptions outlined in their agreement with the MOE, then the latter would have the law on its side in withdrawing the original "licensed to operate" status. The Ministry has done it in the past! Take some time, Doctor, to peruse the Education Act for yourself since you obviously cannot depend on the incompetents whose job it is to advise you....properly !

John French II thanks, hopefully they won't impose some penalty on me before I leave. I did see they had accepted some 8.2 million USD in 2011 (see www.imf.org/external/np/sec/pr/2011/pr1106.htm) after hurricane Tomas but your answer reveals that they must have completed whatever requirement

Rupert J, I also took a look at the education act in Anguilla which is very similar to Antigua, however one difference I noted, while the Antiguan Act Section 53 says: Quote:
Suspension for major offenses (1) The principal of any public school, assisted private school or private school
The Anguilan 2011 Act(www.gov.ai/documents/EducationAct150811_for_Further_Consultation.pdf section 146 ) says
Quote:
Suspension for major offenses (1) The principal of any public school, assisted private school..
It does not include Private schools like the Antiguan & Barbudan legislation.

From my understanding of the regulations that you have quoted they have nothing at all to do with the running of a private institution, I could understand if the school violated the child civil rights and the powers that be has to step in that i would acccept but the right for the institution to choose who they want to work with no government have the right to take that away.But at least I stand corrected.

that means nothing? It also states the procedures regarding disciplinary action, which involve the ministry. Can I conclude that you are suggesting that whatever rules made by the school supersede the laws of the land?

This is very simple the school as a private institution has the right to pick and choose who they wish to serve and no one can do anything about it, my three children went to catholic schools and at the start of each year they bring home a parent/student hadbook that must be signed by both and returned to the schools, this handbook outline what is expected from both child and parent/s so it's either you accept or find somewhere eles to send your kids.

John French II, looking at our primary education system and comparing it to Saint Lucia, I found it interesting that for Saint Lucia this year:Quote:

. Isn't Saint Lucia also on a IMF program, yet their public schools seem to be doing better than ours? Is the answer simply that Saint Lucian's hold their public officials accountable which helps ensure that they get better results than we do? The detailed results for Saint Lucia can be found here www.stlucia.gov.lc/notices/2012-common-entrance-exams-synopsis and its a pity that we cannot get this level of detail from our own ministry of education

Tenman, I'm not sure exactly what your point is here. You point out a clause in the Education Act which specifically refers to suspension, but the student in question has not been suspended?

Minister Leandro is simply afraid of the Father, Son and Holy Ghost who runs the Baptist School. And don't let their Common Entrance results fool you. That school only takes brilliant students.

I disagree with the Ministers conclusion and unless she tells me that the 2008 education act is not law, I will continue to believe she is wrong:
laws.gov.ag/acts/2008/a2008-21.pdf states under power of minister/ section 5:

Suspension for major offenses (1) The principal of any public school, assisted private school or private school may suspend a student for a period of more than two days but not exceeding ten school days for— (a) gross misconduct which may be considered a risk or danger to members of staff or other students; .. (3) When a principal suspends a student the principal shall report in writing to the student’s parents,the Board of Management, if one exists, and the Director of Education and state the reason or reasons for the suspension. 54.(1) The Director of Education may, after the receipt of notification under subsection 53(3) above order, after consultation with the Board of Management if one exists, that— .. (e) the student be expelled
