Picket Brings Victory for Former Deluxe Employees

Former Deluxe EmployeesAntigua St. John's - A group of three young women formerly employed at the Deluxe Cinema on High Street have successfully challenged their unlawful separation from the company in a move that General Secretary of the Antigua and Barbuda Free Trade Union Stafford Joseph considers a “breakthrough” in labour in Antigua.

The women managed to secure severance payment some eight months after being fired.

Joseph explained that some four individuals, one part time, were served with a letter dated December 30 2011 informing them of the closing of the concession stand they worked at cinema. This closure was to last for 2-4 weeks at the most. But they were never recalled.

In February 2012, Joseph said the former employees sought his intervention; that resulted in an agreement being made with the former employees to pay severance over a period of three months.

“I wrote to the employer in February regarding the matter and the workers at that time had not been recalled. My letter indicated that they should be paid off or transferred. We agreed to a payment plan that the employer signed to and that should have ended in May,” Joseph said.

However not only did the employer fail to live up to his end of the bargain in paying the agreed monthly amounts, but he stopped paying altogether after a short time.



“I had to go as far as to file the matter at the Labour Department for intervention,” Joseph said.

But last Friday the three, along with Joseph, resorted to what could be used as a first resort in future cases like these –  picketing.

They gathered outside the entrance to Deluxe Cinema with placards and chanted for their earned dues. This resulted in an almost immediate meeting between Joseph and the employer and the issuance of a check settling all balances.

“I commend the young ladies because you don't find many workers who stand up for their rights especially after losing a job. They calmly picketed and won in the end. It’s sad they had to go that way but it was the only legal avenue available,” Joseph said.

He added that there are several similar cases like this in Antigua & Barbuda, and encouraged employers to do right by those affected and avoid the embarrassment.

“A lot of labour laws are being breached and we are going to start picketing as much as necessary. We are planning along with our membership to picket wherever and whenever we have to peacefully,” Joseph said.

Agree with you on most of your points tenman even thou i dont like max and this is not because of politics, i would not wish to see deluxe go the way of drive in or even jem from years ago. However in the free market system where competition is the name of the game, one has got to make sure they offer consumers quality and timely products or they may just patronize the competition. I an age when movies can be seen instantly via the web who want to wait to see a block buster three and four weeks unless its by choice or they have no other choice.

At least he ( MAX) did not try to DEFRAUD (TRICK) the the GOVT of ANTIGUA & BARBUDA or any other GOVERNMENTof FUNDS (MONIES) (SLU)
The DeLuxe Cinema could have closed it's doors,when the GOVERNMENT OF ANTIGUA BARBUDA gave Caribbean Cinema all the HELP to open in ANTIGUA.
This is a lesson MAX as CEO for De Luxe will have to get in his head DO NOT DO AS WE THE GOVERNMENT DO.
MAX never PROMISSED any one that their UTILITIE BILLS WOULD BE LOWER THAN WHAT THEY WERE PAYING IN 2001/ 02/ 03 and early 2004,but has been going up since EARLY 2004 and is still GOING UP 2012.

Kudos to the three female former Deluxe employees, for standing up for their rights! I am glad to hear they have finally "secure" severance payments! For those in the public that don't believe "picket" works, think again!

Ruler like you, I dislike such employer behavior. Strangely you make no comment, when news is released showing government involved in similar behavior:late payment for workers; workers suspension still on even though cleared; public workers unfairly fired and after years, still not compensated. It seems like Deluxe will soon be closing its doors. The arrival of Caribbean Cinemas and not the government's famous excuse (Global recession), has brought this about. It seems to me that because of its international reach and size, Caribbean Cinemas has been able to get the latest movies more quickly and cheaper than its competitors have. It also has deeper pockets. A lesson in this is the owners of Deluxe should have found a way years ago to expand regionally. For years, quite a few OECS islands had no cinema. Persons within the region must find a way to utilize equity in order to grow. The added question is what will happen to ticket prices in Antigua if and when Deluxe close?

Let's see how he gets votes here in Yorks or Cedar Grove now that the poor people sees how he treats his own workers. how will he treat us if we voted for him? my family and I, the 5 voters in this house, we almost made a mistake and voted for this man Max Fernandez.

Retrenchment is the norm in this country. The Government is threatening retrenchment, the Port, APUA, and many private entities have closed. Why is this issue being politicised ?

Why everything must turn out to be political this matter does not have to do with colour. This is happening to many nationals where employers try to save a buck by not paying severance or regularly rotating workers with short term contracts. Come on it nahh matter who it be red or blue.

Congratulations to the young ladies. YOU SHOWED THE COURAGE THAT FEW WORKERS HAVE NOW A DAYS. Ladies, you took an action to secure your rights AFTER the process was followed. Congratulations Stafford. The Antigua Barbuda Free Trade Union has been doing a good job doing its best for Workers. IT IS REALLY ABOUT WORKERS RIGHTS AND NOT POLITICS. Keep up the good work.

Our Nation needs more individuals such as these three young ladies. Workers in Our Nation have been silent for too, too long on issues of human rights violations from abuse by owners, management and by extention Our Government. I hope People are seeing the light as they stand up for their rights. To some, this might seem to be a small and insignificant victory, however, you three have won a huge victory based upon the odds of you winning. KEEP GETTING UP, KEEP STANDING UP FOR YOUR RIGHTS....Nurse s, APUA Employees, and all others who know that they are been, have been abused in the workplace, THIS IS YOUR Rosa Parks MOMENT. Don't let it pass you by.
